Product Terms

These Terms and Conditions govern your use of the website www.shop.gsffish.com (“Site”)  and your relationship with Global Seafoods (Private) Limited (GSF Fish Shop, we or us) in relation to the services offered on this website. Please read the terms and conditions carefully. If you do not agree to these Terms and Conditions, please do not register for use of the website www.shop.gsffish.com. Please note that to use any of the services provided on the Site, you must accept these terms and conditions.

Amendments

We may revise the terms and conditions from time to time without notice to you including the delivery cost and the delivery/ pick-up time slots. Global Seafoods (Pvt) Ltd reserves the right to refuse to fulfil the order for any reason whatsoever including but not limited to if we at our sole discretion determine that the order is for commercial purpose .

Notwithstanding anything to the contrary in this policy, the event an order is not fulfilled for any reason whatsoever, your payment for the order will be refunded in full within 7 to 14 days.

Delivery
We are precluded by law from delivering any liquor items or meat items on (Full moon) poya holidays. Our delivery service may also not be available on certain holidays in Sri Lanka, which holidays are decided at our discretion. We deliver only within the cities as identified in the Site. Upon delivery of the goods, the person accepting the goods ordered must sign the copy of the invoice. Provided however items delivered as provided herein cannot be returned or exchanged nor any refund be paid in respect thereof for any reason whatsoever.

Note:

• Delivery of the items will be based on the availability of the item you have ordered and on the delivery location.
• Delivery period provided in our site will neither form a condition nor a warranty on the delivery period.
• A delivery fee will be applicable to all orders/ bills for the delivery service and will be mentioned in the order confirmation and checkout.
• As this is fresh produce, please check your goods on delivery.
• Due to safety reasons, goods cannot be returned once accepted by you at delivery.

Intellectual property

The content of the Site is protected by copyright, trademarks, database and other intellectual property rights. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Site without our prior written permission. No license is granted to you in these Terms and Conditions to use any of our trade mark(s).

Limitations

You may not use the Site for any of the following purposes: disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice gaining unauthorized access to other computer systems interfering with any other person’s use or enjoyment of the Site breaching any laws concerning the use of public telecommunications networks interfering or disrupting networks or web sites connected to the Site making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.  We reserve the right to refuse to post material on the Site or to remove material already posted on the Site. You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with: any claim by any third party that the use of the Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice; any claim by any third party that the use of the Site by you infringes that third party’s copyright or other intellectual property rights of whatever nature; and any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Site by you.

Availability of the Site

Although we will use all commercially reasonable endeavors to offer you the best service possible, we do not make any representation that the Site will meet your requirements and/or will be fault free. If a fault occurs on the Site service, you should report it to the Customer Services +94 11 2598831 or by email at globalseafoods@gsffish.com we will attempt to correct the fault as soon as we reasonably can. Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can. Access to the site may be monitored by us or our nominees.

Advertising and Sponsorship

Part of the Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with relevant laws and codes. We are not responsible for any error or inaccuracy in advertising and sponsorship material and make no representation in respect thereof nor make no offer for the sale of any product or service referred to in advertising or sponsorship material on the Site.
 

Third Party Websites, Content, Products and Services

The Site provides links to websites and access to content, products, and services from third parties, including users, advertisers, affiliates and sponsors of the Site. You agree that we are not responsible for the content provided on or by third-party Web sites. You are responsible for reading all policies posted by third party sites regarding their content and/or use of their sites and bear all risks in respect thereof. If you choose to purchase any products or services from a third party, your relationship is with the third party and we are not in any way liable for such product or service including but not limited to: (a). the quality of third-party products or services; and (b). fulfilling any of the terms of your agreement with the third party, including the delivery of products or services and warranty obligations related to such products or services. You agree that we are not responsible for any loss or damage of any sort you may incur from dealing with any third party.

Rights to suspend or cancel registrations

We may suspend or cancel your registration at our discretion including but not limited to in the event of your breach of the obligations under these Terms and Conditions. You may cancel this agreement at any time by informing us in writing at the below address. The suspension or cancellation of your registration shall not affect your obligation to pay for any orders processed by us at the time of suspension or cancelation.

Order Placement

You may place an order to purchase a product offered for sale by us on the Site by following the onscreen prompts after clicking on the item you are interested in. You will have an opportunity to check and correct any input errors in your order by clicking the “View Cart” button on the ‘Order Summary’ page up until the point at which you submit your order. After placing an order, you will receive an e-mail from shop.gsffish.com acknowledging that the order has been received.

Please note that this does not mean Global Seafoods (Pvt) Ltd has accepted the order by you, Global Seafoods (Pvt) Ltd receives full right to inform and decline an order if: (a). the product you ordered is out of stock or discontinued; (b). there is a problem with authorization of the payment on your debit or credit card; (c) if any of the written terms and conditions are violated; or (d) for any other reason deemed appropriate by us.

A separate dispatch confirmation will be issued when the product is handed over to the courier service, along with the original copy of the invoice.

Our acceptance of your order takes place on dispatch of the order.

Our liability

The Site is provided by us without any warranties or guarantees. The Site provides content from other Internet sites or resources and while we try to ensure that material included on the Site is correct, reputable and of high quality, we do not accept responsibility if this is not the case. We are not responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Site. If we are informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can. In particular, we disclaim all liabilities in connection with the following: 1. incompatibility of the Site with any of your equipment, software or telecommunications links. 2. technical problems including errors or interruptions of the Site. 3.unsuitability, unreliability or inaccuracy of the Site. 4. inadequacy of the Site to meet your requirements.  To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Site. Nothing in this paragraph applies to our statutory liability in respect of products sold through the Site.

Maximum liability

Our maximum liability in respect of any loss or damage caused to you by use of the Site and/or services therein is limited to the amount you paid less any costs incurred by Global Seafoods (Pvt) Ltd on products already purchased.

Price and Payments

The price of any Products will be as quoted on our Site from time to time. These prices include VAT but exclude delivery costs, which will be added to the total amount due once you have selected a delivery service from the available options as set out in delivery information.

Global Seafoods (Pvt) Ltd offers a number of payment options ranging from credit/debit card payments and/or cash on delivery.

In the case of Credit/Debit Card payments, you will receive an order confirmation and payment confirmation once payment is confirmed.  In the event you select the option of cash on delivery or your online payment is not realized, you will be expected to settle the payment in cash at the point of delivery of your order. 

By using a credit/debit card to pay for your order, you confirm that the card being used is yours. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your card refuses to authorize payment, we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal. We are not responsible for any loss or damage caused to you due to unauthorized use of your credit/debit card on our site by a third party.

Your payments are going through Secure Payment Site operated by https://webxpay.co/ payment gateway and the respective bank gateways. Your card details will be securely transmitted to the gateways and bank for transaction authorization.
